Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and TryNectar ("we", "us", "our") that governs your access to and use of the website mynectarai.com and any related services, features and content (collectively, the "Service"). By creating an account, accessing or using the Service, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to create an account or use the Service. By using TryNectar you represent and warrant that you meet this age requirement, that you have the legal capacity to enter into these Terms, and that you are not barred from using the Service under any applicable law. We may, at any time and at our discretion, request proof of age and suspend or terminate any account that does not meet the eligibility requirements.

2. Your account

To access most features you must create an account. You agree to provide accurate, current and complete information, to keep that information up to date, and to keep your login credentials confidential. You are responsible for all activity that takes place through your account, whether or not you authorized it. Notify us immediately if you suspect unauthorized use of your account.

You may have only one personal account. Accounts are not transferable. We reserve the right to refuse registration, reclaim usernames, or terminate accounts at our discretion.

3. Description of the Service

TryNectar provides a virtual companion experience powered by artificial intelligence. Users can customize the appearance, personality and mood of an AI character and exchange text messages with that character. The AI generates responses based on the inputs it receives, the persona configured by the user, and the underlying language models we use. AI responses are computer-generated and do not represent the views, beliefs or advice of any real person.

4. Acceptable use

You agree not to use the Service in any way that:

  • Violates any applicable law, regulation or third-party right.
  • Generates, requests or distributes content that depicts minors in any sexual or suggestive way.
  • Depicts real, identifiable people in sexual, defamatory or harassing contexts without their explicit consent.
  • Promotes violence, terrorism, self-harm, hate speech or discrimination.
  • Attempts to extract personal data of other users, scrape the Service at scale, or reverse-engineer the underlying systems.
  • Interferes with the integrity, security or availability of the Service, including by uploading malware or attempting to bypass technical limits.
  • Resells or redistributes the Service or its content without our written permission.

We may, at our sole discretion, remove content, restrict features or terminate accounts that violate these rules. Repeat or serious violations may be reported to law enforcement.

5. User content and AI output

"User content" means anything you submit to the Service, including messages, prompts, persona descriptions and uploaded materials. "AI output" means content generated by the Service in response to your inputs. You retain whatever ownership rights you have in your User content. To the extent necessary to operate the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, process, transmit and display your User content for the purpose of providing and improving the Service.

AI output is generated automatically and may not be unique. The same prompt may produce similar output for different users. To the extent permitted by law, you may use AI output for personal, non-commercial purposes. Commercial use of AI output is permitted only under a paid plan and is subject to additional restrictions.

6. Subscriptions, billing and refunds

Some features require a paid subscription. Prices, billing cycles and feature lists are described on the pricing page at the time of purchase. By subscribing, you authorize us (and our payment processor) to charge the applicable fees and any taxes to your selected payment method on a recurring basis until you cancel.

You may cancel a subscription at any time from your account settings. Cancellation stops future charges; the current billing period is not refunded except where required by law. Free trials, if offered, automatically convert into paid subscriptions at the end of the trial period unless cancelled before the trial ends.

We may change prices for future billing periods with at least 14 days' notice. Continued use of paid features after the change takes effect constitutes acceptance of the new price.

7. Intellectual property

The Service, including its software, design, branding, text, graphics, AI personalities and underlying models, is owned by TryNectar or its licensors and is protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, we reserve all rights in and to the Service. You may not copy, modify, distribute, sell or create derivative works of the Service or its components without our prior written consent.

8. Privacy

Your use of the Service is also subject to our Privacy Policy, which describes how we collect, use and protect your personal data. By using the Service you agree to the practices described in the Privacy Policy.

9. Third-party services

The Service may rely on or link to third-party services (for example, payment processors or model providers). We are not responsible for the content, policies or practices of third-party services. Your use of those services is governed by their own terms and policies.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure, or that AI output will be accurate, appropriate or suitable for any particular use.

AI companions are not a substitute for professional medical, psychological, legal, financial or relationship advice. If you need professional help, please consult a qualified human professional.

11. Limitation of liability

To the fullest extent permitted by law, TryNectar and its officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, goodwill or other intangible losses, arising from or related to your use of the Service. Our total aggregate liability for any claim arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) USD 100.

12. Indemnification

You agree to defend, indemnify and hold harmless TryNectar from and against any claims, damages, liabilities, costs and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your User content or your violation of these Terms.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or if we are required to do so by law. You may terminate these Terms at any time by deleting your account. Sections that by their nature should survive termination (such as intellectual property, disclaimers, limitation of liability and indemnification) will survive.

14. Changes to the Service or Terms

We may modify or discontinue the Service, or any part of it, at any time. We may also update these Terms from time to time. If we make material changes, we will notify you in advance through the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Governing law and dispute resolution

These Terms are governed by the laws applicable in our principal place of operation, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the competent courts of that jurisdiction, except where mandatory consumer protection laws give you the right to bring proceedings in your country of residence.

16. Miscellaneous

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right under these Terms will not be considered a waiver of that right. These Terms, together with the Privacy Policy, are the entire agreement between you and TryNectar regarding the Service and supersede any prior agreements.
